General Terms & Conditions

1. Scope of application
All operations carried out by an Internet user on the Corail Hélicoptères website: www.coraihelico.com, imply acceptance without reservation of the present General Conditions of Sale.
The Client or/and beneficiary declares that he/she is of legal age and has full legal capacity to commit himself/herself under the present General Terms and Conditions of Sale. If not, he must be replaced by his legal representative and ask him to confirm his authorisation in writing on his voucher before any transport of passengers.
Corail Hélicoptères reserves the right to modify at any time the present General Terms and Conditions of Sale according to the evolution of the services offered or the legislation in force, by publishing a new version in the section of the Internet site provided for this purpose. Each order placed after the publication of the new version of these General Terms and Conditions of Sale will be subject to this new version.

2. Flight’s conditions
Corail Hélicoptères is an airline company approved by the French Civil Aviation Authority under the n° FR.AOC.0023 Europe.
Flights are carried out under VFR (visual flight rules, as defined by the French Civil Aviation Authority).
The flights are carried out subject to the authorisations of the competent authorities. As stipulated in the Warsaw Convention (12/01/1929) and the Montreal Convention (28/05/1999), Corail Hélicoptères reserves the right to replace its carriers without prior notice, to use other aircraft of equal or greater value, and to modify the route specified on the ticket, if necessary.
The duration of the flights is approximate and may vary according to weather conditions, air traffic and flight authorisations.

3. Fill rate
Each helicopter is subject to a minimum number of passengers (6 passengers for the H130).
If the number of passengers is lower, Corail Hélicoptères may postpone the flight or cancel the service.

4. Prices and tickets
Prices are “seat prices”, include VAT and are subject to change at any time as they are determined on the basis of full aircraft occupancy.

If there are insufficient passengers on a flight and/or the weather conditions are unfavourable, the company reserves the right to regroup its passengers on other flights or to cancel the flight.
In this case, passengers will be able to
– Board at a different time (subject to availability), in case of choice of this option this becomes definitive. or
– Be refunded the amount of the ticket paid (without any other compensation)
Tickets for children under 2 years of age are free (on their birthday and on presentation of proof).
From the age of 2 until the age of 12 (upon presentation of proof), a “child” rate is applied.
Tickets are not exchangeable or refundable, except by decision of the company, following cancellation of the flight for adverse weather conditions or for any other operational reason.
Gift vouchers are valid for 1 year from the date of purchase. Vouchers cannot be exchanged or refunded unless the company decides otherwise.

5. Flight Schedule
Corail Hélicoptères provides the flight schedules as an indication and reserves the right to modify them by informing the client in advance. The indicated schedules are therefore not guaranteed.

6. Operating Hours
Take-offs take place every day from our bases depending on the type of flight:
In the summer season: from 06:00
In winter season: from 06:45

7. Reservations
Reservations can be made on our website, on site, by phone and/or by email.
Mandatory information to make a reservation:
– Name, first name, sex and date of birth of the passengers
– Credit card numbers (Visa, AMEX, Mastercard): 16 digits, expiration date, cryptogram. (This is to guarantee the reservation)
– Telephone contact

8. Cancellations

The company :
Corail Helicopters reserves the right to cancel a flight due to bad weather conditions or force majeure.
If the flight is cancelled due to bad weather conditions, technical problems or unforeseen restrictions from the authorities, a full refund (only the price paid for the ticket) can be made, or the flight can be postponed to a later date.
Corail Hélicoptères undertakes to confirm, with the client, the nature and schedule of the service the day before before 6pm.

The passenger :
Any passenger has the right to cancel or postpone his scheduled flight, the day before the service before 4pm. After this time, the full price of the service concerned must be paid.
Any passenger who does not show up on the day and at the time of the flight will be charged a penalty equal to 100% of the price of the tour.

9. Delays
Passengers are requested to report to reception at least 30 minutes prior to take-off. The company cannot be held responsible for late arrivals. In such circumstances, Corail Hélicoptères reserves the right to maintain the flight as scheduled. If a passenger arrives more than 15 minutes after take-off time, a cancellation fee of 100% will be applicable.

10. Weather conditions
The weather report is made 15 minutes before the flight (the same day) by the pilot who will then decide if the service will be maintained. It should be noted that weather conditions can change rapidly on the island.
While guaranteeing the safety of the flights, the pilot reserves full discretion and responsibility in deciding whether or not to maintain the flight in the event of adverse weather conditions.

11. Placement on board
Passenger weights will be recorded prior to boarding the helicopter due to regulations and limitations related to weight and balance specifications. Seats in the aircraft are allocated according to the weight of each passenger. The passenger will not be able to decide on his/her seat in the helicopter.

12. Use of cameras
If the shots could be detrimental to the company, Corail Hélicopteres Ltd reserves the right to undertake actions against non-compliance with these terms or the dissemination of such content and to demand an immediate withdrawal. Any footage taken shall not be used for commercial purposes unless permitted by Corail Helicopteres

13. Transfer Flight
Luggages
All helicopters are subject to passengers’ and luggage limitations. The company requires all luggages weights and dimensions (if required) before scheduling the flight.
Flight confirmations sent are based on these weights and the client is under the obligation to inform the company of any change(s). Corail Helicopteres Ltd reserves the right to deny scheduling a flight where the weight limitation is exceeded or when the luggage can not safely fit inside the aircraft’s compartment. It is recalled that certain items transported are classified as dangerous goods (ICAO list), restricted items or unauthorized items and are subject to specific regulations. Passengers shall inform the company as soon as possible.
In case of control procedures (such as security searches) performed by any agent (Police, Customs or Corail Helicopteres), passengers are fully responsible for their luggage even if they have to be transported separately. Transportation of luggage(s) not belonging to a passenger of the flight is forbidden, except if the luggage belongs to the same family group where the flights have been split for weight and balance concerns only.
In the event of a luggage search refusal or a sign that the passenger is concealing a restricted or an unauthorised item, the luggage will not be allowed to board the flight.

14. Right of withdrawal
In the case of tickets purchased on the Internet, it is impossible to assert any right of withdrawal as these are travel or transport services. According to Article L. 121-20-4 of the Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering and leisure services provided on a specific date or at a specific time.

15. Insurance and Civil Liability
The company holds the insurances and Civil Liabilities required as an air carrier. Risks are borne for amounts comparable to those required by the Warsaw Convention in terms of passenger air transport. Items taken by passengers are not taken into account by our insurers. It is the responsibility of the passenger to take additional insurance if he deems it necessary. Corail Helicopteres Ltd shall not be held liable for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, services breakdown or any other unintentional malfunctions.
Corail Hélicoptères cannot be held responsible for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service or other involuntary malfunction.

16. Boarding conditions
No person is allowed to board a helicopter without a valid flight ticket. As a Passenger Air Carrier, Corail Hélicoptères is subject to the conditions stipulated by the Warsaw Convention.
The passenger is obliged to communicate to the company any information requiring particular vigilance: baby, person with reduced mobility, handicap, pregnant woman, etc.
During the flight, the participant undertakes to comply with and respect the safety instructions given by Corail Hélicoptères and to follow the instructions of the pilot who is the “sole master on board”. Corail Hélicoptères pilots have the right to refuse or disembark any person or load that may represent a danger for the safety of the flight.
It is strictly forbidden to smoke, eat and drink during the helicopter flight.

17. Archiving and evidence
Corail Hélicoptères shall archive the order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the French Civil Code. The client is expressly informed that, except in the event of a manifest error for which he/she would provide proof, the data kept in the Corail Hélicoptères databases shall be considered by the parties as proof of the communications, reservations, payments and transactions that have taken place between the parties.

18. Applicable law and settlement of disputes
The present general conditions are subject to French law.
Any dispute, disagreement, failure to settle or difficulty of any kind relating to our services rendered shall be submitted to the jurisdiction of the Tribunal de Grande Instance de Saint-Denis, Ile de la Réunion.
